Qualitative Patent Evaluation Service
Service Overview
In addition to providing support under the Pilot Patent Valuation Support Scheme (PVSS), the Qualitative Patent Evaluation Service is available to other local innovative entities as a separate optional value-added service upon payment. This service is independent of PVSS and is not covered by the subsidy arrangements under the Scheme.
The Qualitative Patent Evaluation Service provided by HKTISC is based on the Guidelines for Patent Evaluation published by the State Administration for Market Regulation and the National Standardization Administration on 6 August 2023 under National Standard No. GB/T 42748-2023 of the People's Republic of China. The Qualitative Patent Evaluation is conducted by the Intellectual Property Department (IPD). The service is available for Hong Kong patents granted under the Patents Ordinance (Cap. 514) that have undergone substantive examination.
The fees for the Qualitative Patent Evaluation Service are set out below.
Scope of Service
Provide a qualitative patent evaluation report. Each report focuses on a single granted Hong Kong patent, covering the following three types:
original grant standard patents, short-term patents that have undergone substantive examination, and re-registered standard patents.
Standard Patent
(Original Grant)
Standard patents granted after substantive examination by IPD, with a protection term of 20 years.
Short Term Patent with Substantive Examination
Short-term patents that have undergone substantive examination by IPD, with a protection term of 8 years.
Standard Patent
(Re-registration)
Standard patents re-registered in Hong Kong based on the patent granted by the designated patent offices, with a protection term of 20 years.
*The designated patent offices are the China National Intellectual Property Administration, the United Kingdom Patent Office and the European Patent Office, in respect of a patent designating the United Kingdom

Fee Charging Mechanism
A concession rate of service fee for original grant standard patent (OGP).
Two different types of reports: comprehensive evaluation and basic evaluation. Comprehensive evaluation includes an additional section on economic value analysis, and is therefore more expensive.
A reduced service fee will apply to any additional technically related patents from the same proprietor, up to a maximum of 5 additional patents per case.

Application Procedure
Step 01
Submitting Application
Submitting the application documents to HKTISC.
Step 02
Pending Notification
HKTISC verifies whether the subject of evaluation requested by the applicant is a HK patent that has undergone substantive examination. Upon successful verification, it will issue a payment notice to the applicant.
Step 03
Payment
The applicant completes the payment according to the amount specified in the notice, then the Intellectual Property Department (IPD) will conduct the evaluation.
Step 04
Collecting Report
Once IPD completes the evaluation, the applicant will receive a detailed patent evaluation report.
